The Corporate Manslaughter and Corporate Homicide Act 2007, which applies throughout the UK, created a new offence of corporate manslaughter (corporate homicide in Scotland). Under the Act, organisations can be prosecuted if the way in which their activities are managed or organised results in a person's death.
The Act does not apply to individuals, such as company directors and managers, although they can still be prosecuted for offences such as gross negligence manslaughter and health and safety breaches.
This factsheet explains what the purpose of the Act is, who it applies to, the offences created by the Act, how it is enforced and the penalties for non-compliance.
